1. About the platform / trademarks
The Service is an independent digital learning and exam preparation platform for German learners. It has no official affiliation with the Goethe-Institut, telc gGmbH, ÖSD (Österreichisches Sprachdiplom Deutsch), TestDaF-Institut, the Federal Office for Migration and Refugees (BAMF) or other examination organisations.
It is neither an official examination centre nor an official licensed partner of these organisations. All trademarks, exam names and designations remain the property of their respective rights holders and are used solely for descriptive, informative and comparative purposes within the permitted descriptive use under applicable trademark law.
The materials are independently developed practice, training and simulation resources, not official examination materials of those institutions.
2. Copyright and intellectual property
All content, including texts, exercises, audio, AI-generated content, graphics, logos, designs, databases, software components, learning materials, exam simulations, assessments and other digital materials, is protected by copyright and other rights.
Content may be used only as intended within the Service. Without Wilhelm Digital GmbH’s express written consent, full or partial reproduction, publication, distribution, automated extraction (scraping), commercial use, transfer to third parties and use for competing offerings are prohibited.
3. Use restrictions
In particular, you must not systematically copy content; extract databases in whole or in part; use content or data to build your own databases; automatically reuse AI-generated content; use content to train other AI systems or for competing platforms; employ automated bots or scripts; circumvent access or protection restrictions; or use the Service abusively or unlawfully.
Violations may result in temporary or permanent suspension of access. Abusive or excessive use of automated functions may lead to temporary restriction or suspension of individual features. All rights reserved.
4. AI-assisted content and assessments
The Service uses AI to support learning, training and assessment. AI-generated assessments, corrections, recommendations and feedback serve learning, training and practice purposes only and are not official examination assessments.
Despite careful development and ongoing improvement, completeness, accuracy, availability or agreement with official examination assessments cannot be guaranteed. AI output may be incomplete, incorrect or misleading; it is not binding professional or legal advice and does not replace a professional language examination or individual expert advice.
5. Paid services and contract formation
Certain features are paid, such as subscriptions or one-time purchases. Services, duration and prices including statutory VAT are clearly shown before checkout is completed.
A contract is formed when you complete the order, for example by clicking the order/payment button, and we confirm it or provide access. The contractual language is German.
Subscription duration, renewal and cancellation follow the conditions shown during checkout. Subscriptions automatically renew after the agreed term unless cancelled in time. For consumers, renewal is for an indefinite period, after which cancellation is possible at any time with no more than one month’s notice (§ 309 No. 9 BGB).
6. Consumers’ right of withdrawal
Consumers generally have a statutory right of withdrawal for paid distance contracts. This does not apply to business customers (B2B).
Withdrawal instructions — Right of withdrawal You may withdraw from this contract within fourteen days without giving a reason. The period is fourteen days from the date the contract is concluded.
To exercise this right, inform Wilhelm Digital GmbH, Philippstraße 27, 52349 Düren, Germany, email: info@wilhelmdigital.de, of your decision in a clear statement, for example by post or email. You may use the model form below, but it is not mandatory. Sending your notice before the withdrawal period expires is sufficient to meet the deadline.
Effects of withdrawal We refund all payments received without undue delay and no later than fourteen days after receiving your withdrawal notice, using the same payment method as the original transaction unless expressly agreed otherwise. You will not be charged any refund fees.
If you requested that services begin during the withdrawal period, you must pay a reasonable amount proportionate to the services provided up to withdrawal compared with the full contractual scope.
Early expiry The right expires early if we fully perform the service and, before performance begins, you expressly agreed to the start before the withdrawal period ends and acknowledged that full performance would end your withdrawal right. For digital services or immediately activated content, the right may expire early under § 356(5) BGB.

7. Service availability
We aim to provide uninterrupted availability as far as possible. There is no entitlement to continuous or error-free availability, and no particular technical minimum standard or uninterrupted service is owed. Maintenance, technical faults, security updates or external factors may cause temporary restrictions.
8. Limitation of liability
You use the Service at your own responsibility. Wilhelm Digital GmbH has unlimited liability for intentional acts and gross negligence and for injury to life, body or health.
For a slightly negligent breach of an essential contractual duty — one whose fulfilment enables proper performance of the contract and on which you may regularly rely — liability is limited to foreseeable damage typical of the contract. Otherwise, liability for slight negligence is excluded. Liability under the German Product Liability Act and expressly assumed guarantees remains unaffected.
9. External links
The Service may link to external websites whose content we do not control. We accept no liability for external providers’ content; responsibility lies exclusively with the respective operator.
10. Consumer dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration body (§ 36 VSBG).
11. Changes
We may amend these legal notices and terms in response to technical, legal or organisational changes. The current version is published on our website.
12. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection rules of the consumer’s country of habitual residence provide otherwise.
